Open Record Frequently Asked Questions

An Open Record is an Oregon only criminal history background check, which provides public record information regarding the subject of inquiry. The report will include any arrests within the last calendar year from the date of the request, provided we have no court information; and any information over 1 year is limited to conviction information only.

You must provide us with the subject's name (as complete as you can provide), a date of birth, and a current or last known mailing address.

If an address cannot be provided, the request cannot be processed.

No. A criminal history report must be based on fingerprints in order to receive a notary seal.

No. Registering for an account will allow you to submit and view the status of your request online. Responses providing criminal history information will be mailed to you by US Mail 14 days after the date it was processed.

Yes. If the record contains reportable information, we are mandated by Oregon law to notify the individual of the request including the name of the person who has requested the background check. If no reportable information is found, the subject is not notified of the request. Responses providing criminal history information will be mailed to you by US Mail 14 days after the date it was processed.

By Oregon law, Oregon State Police must send the individual a copy of the criminal history record and give them the opportunity (14 days) to challenge or provide documents to correct information contained in the record. You will receive the results of the background check regardless of any challenge to this record.

Generally a challenge can be resolved within the 14 day waiting period if the person already has the documents needed to correct the record, but if the person has to request records from the court or provide proof to substantiate the challenge it may cause a slight delay in response time.

No. The waiting period is set by Oregon law and is automatically calculated.

The fee is $33 per request.

Yes. The fee helps cover the cost of maintaining the criminal history records and processing the background check request.

Yes. but if the person has been verified deceased, there will be no record. No refunds will be issued for this search.

No. The Open Records Unit cannot request other state records or national requests for Oregon Open Records requests. Please contact the criminal history reporting agency for individual states or the FBI for more information on the process.

If the background check is already in process no refunds can be issued. If the background check is "submitted" but has not started processing then it is possible. Please contact Oregon State Police Open Records Monday through Friday 8 AM to 5 PM at 503-378-3070 for more information.
